MetaHomes Terms and Condition

These Terms and Conditions (“Terms”) govern your access to, and use of all parts of the website and services branded as MetaHomes (“MetaHomes,” “we,” “our,” “us”). MetaHomes is operated by Metaworld Technology FZ LLC, this includes all documents, data, materials, or other information made available on MetaHomes. “Metaworld Technology FZ-LLC” maintains the https://www.metahomes.net/ Website ("platform"). 

 

By using or accessing MetaHomes, you acknowledge and agree to be bound by the following terms and conditions. MetaHomes is registered in Dubai, and your access to MetaHomes shall be governed by the laws of Emirate of Dubai, United Arab Emirates (UAE). 

 

Please read these Terms carefully, as they contain important information about legal rights and the limitations of those rights, as well as information about applicable law and dispute jurisdiction. If you do not fully agree to these Terms and any other terms and conditions of MetaHomes, you are not authorized to access or otherwise use MetaHomes. If you wish to terminate these Terms, you may close your MetaHomes account at any time and no longer access or use the services. 

 

Definitions 

 

  1. “User” refers to any individual or entity utilizing the MetaHomes platform to advertise or list properties for sale or rent, including agents, brokers or brokerage (“Agents”), or to provide vacation or holiday home rental services, such as hosts (“Host”), as well as other individuals or entities serving as service providers (“Merchants”) within the MetaHomes Life platform. This includes, but is not limited to, property owners, property managers, real estate agents, and brokers who use the platform to advertise or facilitate the sale, rental, or vacation leasing of properties. 

 

  1. “End User” refers to any individual or entity, such as guests, renters, customers, or buyers, who access or utilize the MetaHomes platform to browse, inquire about, or book properties for sale, rent, or vacation purposes. This includes individuals who engage with services listed under MetaHomes Life through the platform. Essentially, an End User is anyone who interacts with the MetaHomes platform to obtain information, make bookings, or access supplementary services provided through the MetaHomes platform. 

 

  1. Host” may refer to the meaning of individuals including property owners or managers who originally advertised their properties on other websites and whose listings have been redistributed on MetaHomes. 

 

  1. MetaHomes Life” refers to a specific category of services available on the MetaHomes platform, provided by Merchants. These services are not limited to property management services, concierge services, cleaning and maintenance services, tour and activity booking, and other vacation-related offerings. Merchants can list their services under MetaHomes Life in the Metahomes platform, making them accessible to End Users looking for supplementary services related to their property or vacation rental needs. MetaHomes Life services are offered in addition to the property listings and facilitate a comprehensive experience for End Users within the MetaHomes platform. 

 

  1. Merchants” may refer to any service providers who are individual or entity providing services within the MetaHomes Life platform.  

 

Eligibility Criteria 

 

By using MetaHomes, you agree to meet the following eligibility criteria: 

 

  • You confirm that you are at least 18 years of age (or older, depending on jurisdiction) and legally capable of entering into binding contracts under applicable laws. 
     
  • Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website. 
     
  • User is responsible for maintaining the confidentiality of his account 

 

  • If you are registering as a business entity, you represent and guarantee that you have the authority to bind the entity to these Terms. If you are acting on behalf of a third party or another entity, you confirm you have the proper authorization to do so. 

 

  • You agree to provide truthful, complete, and accurate information during your registration and throughout your use of the platform. You are responsible for keeping your information up to date and ensuring it remains accurate and up-to-current. 

 

  • You agree to promptly notify MetaHomes of any changes to your information, listings, or contact details, including but not limited to property details, availability, and other relevant information. 

 

  • You agree to comply with these Terms and all applicable laws and regulations while using MetaHomes. 

 

  • You agree and acknowledge that we do not trade with or provide any services to OFAC and sanctioned countries by UAE. 

 

You should read through all the Terms carefully. The Terms constitute a legally binding agreement between you and Metahomes. You are not authorized to use MetaHomes unless you meet the eligibility criteria stated above. Additionally, please read our Privacy Policy and Cookie Policy, as they provide important information regarding the collection, use, and protection of your personal information. 

 

  1. USE OF SERVICES AND RESPONSIBILITIES OF USERS 

 

  1. We urge all Users to act responsibly when using MetaHomes and engaging in transactions related to property listings, rentals, or sales. Users should ensure that they understand and comply with all applicable terms and conditions. 

 

  1. MetaHomes does not own, nor can we contract for, any property listed on the platform. MetaHomes serves solely as an online marketplace that connects Hosts, as well as Agents, with the End Users. 

 

  1. We may provide online booking, reservation, or communication tools that allow Users to interact with each other and enter into rental, purchase, or other agreements. These tools are designed to facilitate transactions but do not make MetaHomes a party to any such agreements. 

 

  1. MetaHomes is not a party to any rental, sale, or other agreement between Users, even if we provide tools for booking rentals, buying or selling properties, or offer ancillary services. While MetaHomes may facilitate transactions, we do not assume any responsibility or liability for agreements made between Users and End Users. 

 

  1. Before making a booking or purchasing a product or service, you may be required to enter into separate agreements or accept additional terms and conditions. MetaHomes or its affiliates may place further restrictions or requirements on your booking, product, or service. 

 

  1. Users are responsible for adhering to all applicable laws, rules, and regulations while using MetaHomes and engaging in any transactions on the platform. This includes compliance with any laws relevant to the use of services or products offered on MetaHomes. 

 

  1. Hosts and Agents are responsible for ensuring that their property listings and rental or sale activities comply with all relevant laws, regulations, and ordinances. This includes, but is not limited to, compliance with tax laws, safety standards, data privacy requirements, zoning laws, anti-discrimination and fair housing laws, and obtaining any necessary permits or licenses. 

 

  1. Although MetaHomes is not a party to any rental or sale transaction and is not liable for compliance with legal or regulatory requirements, there may be situations where we are required by law to provide information related to property listings. We may be legally obligated to comply with requests from governmental bodies, including those related to investigations, litigation, or administrative proceedings, and we may choose to fulfill such obligations at our sole discretion. 

 

  1. LIMITED LICENSE TO USE METAHOMES 

 

  1. MetaHomes grants Users a limited, revocable, non-exclusive license to access and use the MetaHomes platform, including its content and services, solely for the following purposes: 

 

  1. Advertising a property for sale, rent, or other services; 

 

  1. Searching for properties, researching, or inquiring about purchasing properties; 

 

  1. Purchasing or inquiring about any products or services offered on MetaHomes; 

 

  1. Participating in interactive areas, forums, or communication channels hosted on MetaHomes;  

 

  1. Engaging in any other activities expressly stated as permissible on MetaHomes. 

 

  1. Any use of MetaHomes that is not for one of these purposes or otherwise in accordance with the Terms or as otherwise authorized by us in writing is expressly prohibited. 

 

  1. UNAUTHORIZED USES OF METAHOMES 

 

  1. The license to use MetaHomes only extends to the specific uses described in these Terms. 

 

  1. The license to use MetaHomes granted to Users does not include any right to collect, aggregate, copy, scrape, duplicate, display, or create derivative uses of MetaHomes, nor does it include the use of data mining, robots, spiders, or similar data extraction tools, unless explicitly authorized by MetaHomes in writing. 

 

  1. An exception applies to general-purpose internet search engines that gather information solely for the purpose of displaying hyperlinks to MetaHomes. These search engines must operate from a stable IP address or range of IP addresses, use an easily identifiable agent, and comply with our robots.txt file. 

 

  1. This exception does not apply to websites or search engines that provide classified listings, property rental/sales advertisements, or similar services that compete with MetaHomes, including any service operating in the property rental/sales sector. 

 

  1. Unauthorized uses of MetaHomes also include, but are not limited to, the following: 

 

  1. Any commercial use of MetaHomes or its content, other than by Hosts/Agents in good standing or those licensed to use the software on MetaHomes. 

 

  1. Using MetaHomes or its tools for booking or soliciting rental/sale transactions for properties not listed on MetaHomes. 

 

  1. Copying, reproducing, uploading, posting, displaying, republishing, distributing, or transmitting any content from MetaHomes in any form. 

 

  1. Reproducing any portion of MetaHomes on your platform, using framing techniques or mirroring any content. 

 

  1. Deep linking to any portion of MetaHomes without our express written permission. 

 

  1. Modifying, translating, or creating derivative works from any content or part of MetaHomes. 

 

  1. Reverse engineering any part of MetaHomes. 
  1. Selling, offering for sale, transferring, or licensing any portion of MetaHomes to third parties. 

 

  1. Using MetaHomes for any purpose other than advertising or researching rentals/sales or making legitimate inquiries to hosts/agents. 

 

  1. Posting or transmitting false, fraudulent, or misleading information, or engaging in any activity under false pretenses, such as phishing. 

 

  1. Posting or transmitting unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, sexually explicit, pornographic, or profane material. 

 

  1. Violating the intellectual property rights of MetaHomes or third parties, including copyright, trademark, or patent infringement. 

 

  1. Using MetaHomes in any way that negatively impacts the platform's performance or functionality. 

 

  1. If you are aware of, or experience, any content, activity, or communication through or in connection with MetaHomes that appears to be in violation of the above restrictions or any other provision of these Terms, we ask that you please inform us by contacting us as set forth under “Contact Us” below. 

 

  1. COPYRIGHT NOTICE OF METAHOMES  

 

  1. MetaHomes, including its name, logo, and all content, materials, and information on the MetaHomes platform, are protected by copyright, trademark, and other intellectual property laws of the Emirate of Dubai, UAE. MetaHomes, including its name, logo, and all associated content and materials, are protected by copyright, trademark, and other intellectual property laws. The MetaHomes logo and associated marks are used under a valid license agreement and are the property of Metaworld Technology FZ-LLC. All rights are reserved. By accessing and using MetaHomes, you acknowledge that MetaHomes, its trademarks, and all content and materials provided on the platform are the exclusive property of Metaworld Technology FZ-LLC, its affiliates, or licensors, and you agree to abide by any and all copyright, trademark, and intellectual property rights related to them. 

 

  1. Copying, storing, modifying, displaying, distributing, or otherwise using MetaHomes, its name, logo, or any content on the platform for any commercial purpose, other than in accordance with a valid listing, is expressly prohibited without prior written permission from MetaHomes or the respective rights holders. 

 

  1. As part of the rental/purchase inquiry or reservation process, you may, for your own personal, non-commercial use only, download, display, or print one copy of the content from MetaHomes. However, you may not modify or alter any content or use it for any further distribution, commercial purpose, or derivative work. Any unauthorized use, reproduction, or distribution of MetaHomes’ intellectual property may result in legal action. 

 

  1. You agree not to infringe upon the intellectual property rights of MetaHomes, and you acknowledge that the rights to all content and materials on the MetaHomes platform, unless otherwise noted, are owned by MetaHomes or third-party licensors. 

 

  1. We respect the intellectual property rights of others. MetaWorld does not permit, condone, or tolerate the posting of any content on MetaHomes that infringes the copyright or intellectual property rights of any third party. If you become aware of or suspect any copyright infringement on MetaHomes, please notify us in accordance with terms mentioned herein. In appropriate circumstances, MetaWorld will terminate the accounts Users who are found to be repeat infringers of copyright. 

 

  1. USAGE AND PROTECTION OF DATA 

 

  1. When you provide your email address, name, contact information, or any other personal data in connection with your use of MetaHomes or any services, features, or tools provided by MetaHomes, you agree to allow MetaHomes and its affiliated websites to collect and store your personal data in our user database. This may include details of User and End User, but is not limited to, your name, email address, and any other information you provide to us during registration or usage. By submitting such information, you consent to receive promotional communications, updates, or newsletters from MetaHomes or its affiliated websites. You may choose to opt-out of receiving such communications at any time by following the unsubscribe instructions provided in such emails or by contacting us directly. 

 

  1. We value and prioritize your privacy. For further details on how we collect, use, and protect your personal data, please refer to our Privacy Policy. Your use of MetaHomes constitutes your acknowledgment of an agreement to the terms outlined in our Privacy Policy. MetaHomes adheres to strong privacy practices to safeguard your personal information. You agree that we may access and use your User-contributed content in accordance with these Terms and our Privacy Policy. We further agree that we will disclose your personal information only as necessary to comply with legal obligations, protect our rights, or as otherwise set forth in our Privacy Policy. 

 

  1. You have the right to request access, correction, or deletion of your personal data held by MetaHomes in accordance with applicable data protection laws. If you wish to exercise these rights or if you have any questions regarding how your data is handled, please contact us as specified in the "Contact Us" section. 

 

  1. IDENTITY VERIFICATION 

 

  1. User verification on the Internet is inherently challenging, and MetaHomes cannot and does not guarantee the identity of any individual User. While we provide tools for communication between End Users, Agents, Hosts, and other Users via MetaHomes, these tools do not guarantee the accuracy of the User’s identity. We strongly encourage Users to exercise caution and verify the identity of individuals with whom they are interacting on the platform. 

 

  1. We recommend that Users take additional reasonable measures to verify the identity of other parties. For End Users, this includes confirming the property and relevant details of your booking or proposed rental or purchase. We encourage thorough communication, review of property listings, and possibly independent verification of information before proceeding with any transactions. 

 

  1. You are solely responsible for maintaining the confidentiality of your MetaHomes account credentials, including your User ID and password. By agreeing to these Terms, you undertake to: 

 

  1. Keep your account password and User ID secure and confidential and share it only with authorized individuals. 

 

  1. Instruct any person to whom you provide your credentials not to disclose it to any unauthorized person. 

 

  1. Notify MetaHomes immediately if you suspect any unauthorized access to your MetaHomes account or your email account and promptly select a new password and User ID. 

 

  1. Notify MetaHomes immediately if you are contacted by any individual or entity requesting your account details, User ID, or password. 

 

  1. If MetaHomes suspects any unauthorized access to your account, we reserve the right to request that you promptly change your User ID and password. You agree to cooperate with MetaHomes in taking reasonable actions to secure your account, including complying with any other security measures or instructions we may require. 

 

  1. We discourage you from sharing your User ID and password with any third party. However, if you choose to share your credentials or fail to secure your account details, you are responsible for any and all actions performed through your account, including unauthorized or fraudulent transactions. This includes transactions that you did not intend or authorize. 

 

  1. You acknowledge and agree that neither MetaHomes nor its affiliates will be liable for any unauthorized transactions made using your account credentials. You understand that if your account or email credentials are used without your authorization, you may be liable to both MetaHomes and other Users for any resulting damages, losses, or legal actions. 

 

  1. MetaHomes reserves the right to suspend, cancel, or deactivate your account or property listing at any time, with or without notice, if we reasonably suspect that your account is being used in an unauthorized, fraudulent, or unlawful manner. This action may be taken at our sole discretion and without prior notification to you. 

 

 

  1. COMMUNICATIONS BETWEEN USERS AND END USERS 

 

  1. You agree that any personal information you obtain directly or indirectly from another User or End User via MetaHomes, or through any related communication, transaction, or software on the platform, is strictly for the purpose of facilitating communication relevant to the services provided by MetaHomes. Such communication may include, but is not limited to, inquiries about properties, booking arrangements, or any necessary correspondence for financial transactions. You may not use this information for unsolicited commercial messages or for any unlawful purpose without the express permission of the User or End User from whom the information was obtained. 

 

  1. You agree that, in all cases, if you collect or store personal information about other Users or End Users (such as email addresses or phone numbers), you must provide them with a way to opt-out or remove their information from your address book, database, or records. Additionally, Users or End Users must be able to review what information you have collected about them. Under no circumstances may you disclose any personal information about another User to third parties, unless explicitly authorized by the User in accordance with these Terms. 

 

  1. You agree to protect the privacy of other User’s or End User’s personal information with at least the same level of care as you protect your own confidential information, and you take full responsibility for any misuse, loss, or unauthorized disclosure of such information. This includes preventing the transfer of information to third parties without prior consent from the relevant User or End User. 

 

  1. MetaHomes has a zero-tolerance policy toward spam or unsolicited communications. You are not permitted to add any MetaHomes End User — whether they have rented or purchased a property from you or not — to your mailing list (email or physical mail) without their explicit consent. You are also prohibited from using the platform to send spam, unsolicited commercial messages, or any form of mass marketing that violates these Terms. 

 

  1. You agree not to use any tool or service provided by MetaHomes to send unsolicited communications, engage in spam, or carry out any activity that would violate these Terms or relevant privacy laws. 

 

  1. If we become aware that you are attempting to solicit or contact other User or End User by obtaining their personal information (such as email addresses or phone numbers) from MetaHomes without consent, we reserve the right to report this behavior to the relevant authorities. Please be aware that violations of UAE Cybercrimes law may result in severe penalties, including imprisonment, and legal action may be taken against you under applicable UAE laws. 

 

 

  1. USER-GENERATED CONTENT AND REVIEWS 

 

  1. MetaHomes does not undertake any obligation to pre-screen, review, or monitor content submitted by Users, including but not limited to property listings, property reviews, feedback on agents, or any other content provided by Users or third parties on behalf of Users (collectively, "User-Generated Content"). MetaHomes does not guarantee the accuracy, completeness, or reliability of such content and expressly disclaims any responsibility for it. USERS ARE SOLELY RESPONSIBLE FOR THE CONTENT THEY POST OR PROVIDE ON METAHOMES. YOU AGREE THAT YOU WILL EXERCISE CAUTION AND DUE DILIGENCE IN UPLOADING, SHARING, OR SUBMITTING ANY CONTENT. METAHOMES DISCLAIMS ANY AND ALL LIABILITY FOR THE ACCURACY, OWNERSHIP, OR AUTHORIZATION OF ANY CONTENT POSTED BY USERS, INCLUDING USER-GENERATED CONTENT. IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOU HAVE ALL THE NECESSARY RIGHTS, PERMISSIONS, AND LICENSES TO USE, POST, AND SHARE THE CONTENT ON METAHOMES. METAHOMES DOES NOT ASSUME ANY LIABILITY FOR ANY CLAIMS ARISING FROM THE USE OR MISUSE OF USER-GENERATED CONTENT, INCLUDING COPYRIGHT INFRINGEMENT OR OTHER VIOLATIONS OF THIRD-PARTY RIGHTS. 

 

  1. While MetaHomes does not have a general obligation to monitor User-Generated Content, it reserves the right to review, monitor, and remove any content that violates these Terms, does not comply with MetaHomes’ content guidelines, or is deemed inappropriate, misleading, or otherwise unsuitable, at MetaHomes' sole discretion. 

 

  1. In the event that any User-Generated Content is flagged by a User or End User or brought to MetaHomes’ attention through any other means, we reserve the right to investigate and remove such content if it is found to breach these Terms or any applicable laws, as determined by MetaHomes in its sole discretion. 

 

  1. MetaHomes may, at its discretion, make non-substantive edits to User-Generated Content solely for compliance with formatting guidelines or to ensure adherence to MetaHomes' content standards. This may include, but is not limited to, modifications related to translations, layout, or minor corrections to improve clarity or consistency. Users are solely responsible for ensuring the accuracy and completeness of their User-Generated Content. 

 

  1. By submitting User-Generated Content, you represent and warrant that you have the necessary legal rights to the content and that the content does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party. You further warrant that such content complies with all applicable laws and does not violate any of the prohibitions set forth in these Terms. 

 

  1. Specifically, you agree that your User-Generated Content will not: 

 

  1. Infringe the intellectual property rights of MetaHomes and others, including but not limited to copyright, trademark, or rights of publicity, or violate any applicable law; 

 

  1. Contain personal or confidential information of any third party, including identifying information such as email addresses, phone numbers, or any information that could be used to contact another individual without their consent; 

 

  1. Include unsolicited advertisements, promotional materials, political campaigns, or other types of solicitation; 

 

  1. Be unrelated to the specific purpose of MetaHomes, including the listing, renting, or selling of properties, or the provision of vacation rental services;  

 

  1. Contain false, misleading, defamatory, libelous, obscene, vulgar, harassing, threatening, or offensive material, or any content that promotes illegal activity or violates any other applicable laws or regulations; 

 

  1. Misrepresent your relationship with any person or entity, including MetaHomes, or impersonate any person or entity; 

 

  1. Introduce harmful software, viruses, or any other malicious code that could damage or interfere with the operation of MetaHomes or other Users' devices or systems. 

 

  1. Users, whether acting as property Hosts, Agents, or real estate brokers, are solely responsible for the accuracy, legality, and completeness of the property listings they submit to MetaHomes. MetaHomes expressly disclaims any liability for inaccuracies or disputes arising from property listings, reviews, or any breach of contract that may occur between a User and an End User. 

 

  1. Hosts and Agents are responsible for ensuring that the information they provide about their properties, including but not limited to pricing, location, availability, and amenities, is accurate and up to date. MetaHomes does not verify or guarantee the accuracy of any property listing content submitted by Users. 

 

  1. MetaHomes makes no representations or warranties regarding the accuracy, completeness, or timeliness of property listings, reviews, or other content available on the platform. All Users (including End Users) are encouraged to independently verify the details of any property before making a purchase or rental commitment. 

 

  1. MetaHomes may, at its discretion, modify property descriptions or geographic identifiers used to categorize and display listings on the platform. Such changes may be made without notice and may affect the location or description of listed properties. 

 

  1. Notwithstanding the above, MetaHomes assumes no responsibility for verifying the content or location of any property listing, and Users (Hosts/Agents) are solely responsible for maintaining accurate property details. End Users are advised to confirm any details related to a listing, including location, amenities, and availability, prior to making a reservation. 

 

  1. All other User-Generated Content on MetaHomes, including reviews, comments, and feedback, is the sole responsibility of the User who contributed it. MetaHomes disclaims any liability for such content and does not endorse or guarantee the accuracy or completeness of any User-Generated Content. 

 

  1. By submitting User-Generated Content, you represent and warrant that you either own the content or have obtained all necessary rights and permissions to submit such content. MetaHomes reserves the right to request proof of ownership or permission and may refuse to post or remove any content if such proof is deemed insufficient by MetaHomes in its sole discretion. 

 

  1. By submitting content to MetaHomes, you grant MetaHomes and its affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, display, and otherwise exploit the content in any manner, including for promotional purposes. This license includes the right to sublicense the content to third parties. 

 

  1. Notwithstanding the above, upon the expiration or termination of a property listing, MetaHomes will no longer display any User-Generated Content associated with that listing. 

 

  1. MetaHomes reserves the right to assist Users in protecting their User-Generated Content, including but not limited to providing support in claims for copyright infringement or seeking injunctive relief to prevent the unauthorized use of such content by third parties. While MetaHomes does not assume responsibility for taking legal action on behalf of Users, we will, upon request, cooperate with Users and assist them in enforcing their rights regarding the unauthorized use or distribution of their content. 

 

  1. You acknowledge and agree that MetaHomes may sublicense the rights granted to it under these Terms to third-party service providers or affiliates for the purpose of promoting or distributing User-Generated Content. 

 

  1. To the extent permitted by law, you waive any moral rights or other rights of attribution or integrity in the User-Generated Content submitted to MetaHomes and consent to the use, modification, and exploitation of such content in any manner by MetaHomes or its affiliates. 
     
  1. SERVICE FEE PAYABLE BY END USERS AND CURRENCY 

 

  1. MetaHomes charges a service fee for the services provided by the Users. This fee is payable in two (2) methods, and the specific details of the service fee, including its application and payment terms, will be outlined in a separate agreement between the User and MetaHomes as follows;  

 

  1. Agents shall enter into a separate agreement with MetaHomes Brokerage.  MetaHomes will not provide any payment facility for transactions between End Users and Agents nor deduct any service charges from the End Users. 

 

  1. For Hosts and Merchants, the service fee is included in the payments made by End Users who book properties, rent holiday homes, or purchase other services through the MetaHomes platform. Metahomes will provide the payment processing facility through the platform and deduct the service fee, which covers the provision of MetaHomes' services, including but not limited to customer support (available from 9 am to 6 pm from Monday to Friday), platform maintenance, and other related services. The service fee is calculated as a percentage of the total reservation amount, which may include additional charges such as booking fees, damage deposits, and other applicable fees. MetaHomes may extend customer support to 24/7 in the future. 

 

  1. Depending on the applicable laws in the jurisdiction of the User or End User, VAT may be applied to the service fee. The exact service fee amount will be displayed to End Users at the time of booking. The service fee will be charged once both the User and the End User confirm the reservation as per the applicable services. 

 

  1. The service fee will only be refunded if the End User is entitled to a full refund of the rental amount under the terms of the cancellation policy specified in this Term. Hosts agree not to encourage or advise End Users to circumvent or avoid the service fee charged by MetaHomes. 
     
  1. The displayed price and currency at the Metahomes checkout page, will be the same price and currency printed on the transaction receipt and the amount charged to the card will be shown in your card currency. 

 

  1. Prices on MetaHomes are displayed in AED and USD. The currency used for payment is generally based on publicly available exchange rates, but MetaHomes does not guarantee the rate offered will be the best available. The exact amount the End User will be charged in their local currency will be clearly displayed at checkout. 

 

  1. If the currency of payment differs from the currency of the End User's card, the End User's bank or card provider may charge additional foreign exchange, transaction, or other fees. 

 

  1. SOCIAL MEDIA OR THIRD-PARTY WEBSITES 

 

  1. If MetaHomes offers a tool or service that allows access to or use of any profile or other information about you that you have provided to Facebook or any other third-party website (each a “Social Media Site”), and you decide to use such tool or service, you acknowledge and agree to the following: 

 

  1. The information or content that forms part of your profile on the Social Media Site, which you have designated as “public” (or a similar designation), may be accessed and used by MetaHomes. 

 

  1. Any content derived from your Social Media Site profile will be considered User-Generated Content under these Terms, and MetaHomes shall have the same rights and responsibilities with respect to such content as described herein. 

 

  1. If any Social Media Content is misclassified as public, inaccurate, or otherwise disagrees with your preferences, you agree to work directly with the relevant Social Media Site to make changes or resolve any disputes. You acknowledge that MetaHomes will not be responsible for providing recourse in such cases. 

 

  1. The operation of your profile and account on the Social Media Site shall continue to be governed by the terms and conditions and privacy policy of that Social Media Site, and MetaHomes has no control over or responsibility for these external platforms. 

 

  1. MetaHomes may contain links and pointers to other Internet sites, resources, and sponsors. Links to and from MetaHomes to other third-party sites, maintained by third parties, do not constitute an endorsement by MetaHomes of any third parties or the contents thereof. 

 

  1. MetaHomes may also provide tools to allow interaction between MetaHomes and a third-party site, such as a Social Media Site. However, MetaHomes is not responsible for any third-party sites or resources. 

 

  1. You agree to use such third-party websites and resources at your own risk. We recommend that you review the terms, conditions, and privacy policies of any third-party websites and applications before using them. 

 

  1. TRANSLATIONS AND MAPS 

 

  1. If any User-contributed content, including listings or descriptions provided by Users, is translated for display on MetaHomes or any affiliate site of MetaWorld, we do not guarantee the accuracy, completeness, or quality of such translation. The User is solely responsible for reviewing, verifying, and ensuring the accuracy of any translated content. 

 

  1. Maps displayed on MetaHomes, provided by Mapbox, are subject to the terms and conditions of Mapbox, which can be found at: https://www.mapbox.com/legal/tos. 

 

  1. USERS’ IDEAS AND FEEDBACK 

 

  1. Users may submit ideas, suggestions, or feedback related to MetaHomes, including but not limited to ideas for new or improved products, technologies, website or tool enhancements, marketing plans, or new product names. While MetaHomes is under no obligation to review, consider, or act upon any submissions provided by Users, we may, at our discretion, take them into consideration. 

 

  1. If you choose to submit any ideas, original creative works, suggestions, or other materials (collectively, "Submissions"), the following terms will apply, regardless of the form or medium through which such Submissions are made. 

 

  1. These terms are intended to prevent any misunderstandings or disputes in the event that any part of MetaHomes' business, such as our products, platforms, websites, apps, technologies, or marketing strategies, appears similar to your Submissions. 

 

  1. By submitting any Submissions, you agree that: 

 

  1. Your Submission and its contents will automatically become the exclusive property of MetaHomes, without any compensation to you. 

 

  1. MetaHomes has the right to use, modify, distribute, or otherwise exploit any Submission and its contents for any purpose, in any manner, and without any further obligation to you. 

 

  1. There is no obligation for MetaHomes to review or respond to any Submission. 

 

  1. MetaHomes is not obligated to keep any Submission confidential. 

 

  1. AI-POWERED PLATFORM AND SOFTWARE SERVICES 

 

  1. MetaHomes provides an AI-powered platform that allows Users, to list properties for sale or rent, as well as to offer related services. The platform uses artificial intelligence algorithms to provide an efficient property search, recommendation, and booking service for End Users. All AI-driven tools, software, and technologies used on the MetaHomes platform are the intellectual property of Metaworld Technology FZ LLC, its affiliates, or identified third-party licensors. All rights to such software are reserved. 

 

  1.  MetaHomes grants User and the End User a limited, personal, non-transferable, non-exclusive license to use the AI-powered platform and services for the sole purpose of listing, searching, booking, or renting properties in accordance with these Terms. This license is granted only for personal, non-commercial use and may not be used for any other purpose without the express written consent of MetaHomes or applicable third-party licensors. 

 

  1. The AI-powered services, including property listings, recommendations, and booking systems, are provided "as is" and are warranted only in accordance with any additional license agreement, if applicable. Copying, reproducing, modifying, distributing, or creating derivative works based on the AI-powered software or services is strictly prohibited unless expressly authorized. 

 

  1. You agree not to reverse engineer, decompile, disassemble, or attempt to discover the underlying source code of the AI algorithms or any other proprietary software associated with MetaHomes, except to the extent permitted by applicable law. 

 

  1. MetaHomes reserves the right to update, modify, or discontinue the AI-driven services, software, or any features on the platform at its discretion. Any updates or changes to the platform will be governed by these Terms unless specifically stated otherwise. Users acknowledge that any property listings or other related services submitted to MetaHomes may be processed and displayed using AI algorithms, and it is the User’s responsibility to ensure that their listings and associated content are accurate and up to date. 

 

  1. ADDITIONAL TERMS FOR HOSTS  

 

  1. In order to list a property on MetaHomes, Hosts must comply with MetaHomes Marketplace Standards. These standards include, but are not limited to: 

 

  1. Maintaining an accurate reservation calendar. 

 

  1. Responding to booking requests within 24 hours. 

 

  1. Accepting a reasonable number of inquiries and bookings to ensure a positive guest experience. 

 

  1. Refraining from cancelling a material number of confirmed bookings. 

 

  1. Hosts shall represent and warrant that they either own or have the necessary rights to rent out the property listed on MetaHomes and must not wrongfully withhold rental deposits. 

 

  1. Hosts are responsible for ensuring the accuracy of their listings, including descriptions, photos, and details about the property’s condition, location, and amenities. 

 

  1. Hosts agree not to wrongfully deny access to the listed property to guests who have made a valid reservation. 

 

  1. Hosts must provide, upon request, documentation verifying ownership, accuracy of listing content, and their authority to list the property as requested by MetaHomes. 

 

  1. If a Host is a tenant, they must confirm with their landlord whether their lease agreement permits listing the property on MetaHomes. 

 

  1. MetaHomes does not guarantee that your listing will appear in a specific order in search results. The order of listings is determined by various factors, such as subscription level, listing quality, host response time, calendar updates, End User (guest) preferences, and compliance with platform standards. 

 

  1. MetaHomes reserves the right to use algorithms and methods to optimize the display of listings based on factors relevant to user experience, including the "Recommended Match" for End Users and the Listings distributed on third-party platforms are not guaranteed to appear in any specific order or at all. 

 

  1. While MetaHomes does not have a general obligation to monitor User-Generated Content, it reserves the right to review, monitor, and remove any content that violates these Terms, does not comply with MetaHomes’ content guidelines, or is deemed inappropriate, misleading, or otherwise unsuitable, at MetaHomes' sole discretion. In such situation, MetaHomes reserves the right to reject or remove content that does not meet platform standards or is deemed unacceptable. Hosts are responsible for ensuring that all content displayed on their listings is accurate and represents the property as it is intended. Hosts should also regularly review and update their listings as necessary. 

 

  1. In addition to the other terms set forth herein, Users who are Hosts utilizing any tools provided by MetaHomes or third-party providers that enable online booking and payment for property rentals and bookings (collectively referred to as the “Reservation Services”) agree to be bound by the following additional terms. These terms supplement any other applicable terms and conditions for using the MetaHomes platform. 

 

  1. If the Reservation Services include payment or other services provided by third-party providers, such services are governed by the additional terms and conditions, as well as the privacy policies, of the relevant third-party providers. By using such services, you agree to comply with these third-party terms and policies. 

 

  1. MetaHomes offers Reservation Services to manage inquiries, quotes, rentals, and payments related to property rentals. Hosts must carefully review these terms, as well as the terms and conditions of any third-party provider offering services through the platform. 

 

  1. If you do not agree to these additional terms or the terms of the third-party provider, you do not have the right to access or use the Reservation Services. Failure to comply with these terms may subject you to civil, criminal, or other legal penalties, and you may be held liable for any violations. 

 

  1. Products And Services Offered at Time of Use for Hosts 

 

  1. The types of products, services, and features (including the terms and operations thereof) available to Hosts at the time of listing properties or services for booking on MetaHomes are subject to the descriptions displayed at the time of use or purchase. These offerings are subject to change without prior notice or approval. 

 

  1. MetaHomes reserves the right to offer additional products, services, or features for purchase at any time, which may become available to Hosts for the listing, booking, or reservation processes. 

 

  1. Payment Method Policy for the Host 

 

  1. Subject to the provisions of Clause 9 of this Terms, the Host agrees that they shall not request any End Users to make payments via cash by mail, or utilize any instant-cash wire transfer services, including but not limited to Western Union or MoneyGram, for any part of the property rental transaction conducted through MetaHomes. The Host acknowledges that such payment methods are not acceptable on the MetaHomes platform. 

 

  1. Any violation of this payment method policy, or any other payment method deemed unacceptable by MetaHomes, may result in the immediate removal of the non-compliant listing from the platform. This action will be taken without prior notice to the Host and without any refund of fees paid by the Host. 

 

  1. From time to time, MetaHomes may become aware of attempts by Users to conduct transactions involving unauthorized or fraudulent payment methods. While MetaHomes endeavors to assist in preventing such transactions, the platform assumes no liability or responsibility for identifying, preventing, or informing Users of any fraudulent or unauthorized activity. 

 

  1. The Host acknowledges that End Users may incur certain fees imposed by their banks or credit card companies, including but not limited to foreign transaction fees, related to the rental of properties on MetaHomes. These fees are outside of the control of MetaHomes. 

 

  1. Hosts are responsible for reviewing and understanding any fees or charges that may be imposed by the End User's bank or credit card company in connection with a transaction. MetaHomes will not be held responsible for any such fees or for resolving disputes between the End User and their financial institution. 

 

  1. The Host agrees not to intentionally provide false or misleading information when using MetaHomes' online payment services. This includes, but is not limited to, providing false information during transaction processing, listing creation, or payment procedures. 

 

  1. The Host agrees not to falsify, forge, or tamper with any information contained in emails received as part of MetaHomes' online payment services. Any such activity will result in immediate action being taken, including the removal of listings and suspension of the Host’s account. 

 

  1. To ensure the Host’s full legal rights and payment security, it is prohibited for the Host to accept payment through a third party or to use a credit card not registered in End User’s (guest’s) name. The Host agrees to process payments only through legitimate, verified accounts in their name, ensuring all transactions comply with MetaHomes' security policies. 
     
  1. Cancellations and Refunds Policy for Hosts and End Users 

 

  1. The following cancellation and refund policies apply to all bookings made through the MetaHomes platform. These policies are designed to offer flexibility while ensuring that both Hosts and Users/End Users are treated fairly and equitably. 

 

  1. Cancellation and refund policies are determined by the Hosts. It is at the discretion of the Host to set the terms and conditions for cancellations and refunds, including the timing and eligibility for refunds. End Users should review the specific cancellation and refund policy set by the Host at the time of booking to understand the terms that apply to their reservation. 

 

  1. The eligibility for a refund, as well as the applicable refund amount, will depend on the timing of the cancellation and the type of booking. End Users should review the specific conditions outlined below to understand the refund eligibility for their booking.

  1. Non-Refundable Bookings 

 

  1. Hosts may choose the type of cancellation policy they wish to apply to their properties or listings, including the option for non-refundable bookings. End Users must accept the cancellation policy set by the Host at the time of booking. 

 

  1. However, by choosing the non-refundable option, End Users acknowledge and agree that no refunds will be issued if they cancel the booking, regardless of when the cancellation occurs. 

 

  1. The Host will retain the full booking amount paid by the End User, and MetaHomes will release the payment to the Host upon confirmation of the booking. 

 

  1. Online Booking and Payment Requirements 

 

  1. All bookings on the MetaHomes platform require full payment to be completed at the time of booking. We do not offer "pay-per-booking" listings. Transactions for all bookings must be processed through the MetaHomes platform using the available payment methods. We accept Visa, Union Pay, American Express or MasterCard debit and credit cards in AED and USD. Only after full payment is made will the booking be confirmed and processed. 

 

  1. Payments for bookings made via the MetaHomes platform will be processed through MetaHomes’ integrated payment system or via third-party payment providers as detailed during the booking process. 

 

  1. For payments processed by third-party payment providers, such payments are subject to the terms and conditions and privacy policies of the respective third-party provider. MetaHomes is not responsible for any issues arising from the use of third-party payment providers, and Users/End Users should review the relevant terms before making payments. 
     
  1. Once the payment is completed, the confirmation notification will be sent to the user via email within 24 hours of receipt. 

 

  1. METAHOMES BROKERAGE AGENT TERMS 

 

  1. In addition to the general terms and conditions, Agents operating through MetaHomes are governed by further terms that address their relationship with the platform. These terms provide additional clarity and protection for all parties involved in property transactions conducted via MetaHomes. This arrangement will be governed by the terms between Agents and MetaHomes Real Estate Brokerage LLC (referred to as "MetaHomes Brokerage") [for the purpose of this Term section 15, ‘MetaHomes’ includes the meaning of MetaHome Brokerage].  

 

  1. Agents listed on MetaHomes are entitled to list properties, engage with buyers, and facilitate property transactions in accordance with the guidelines, policies of MetaHomes Brokerage, and applicable local laws. Agents will also be subject to additional terms specific to their activities, including commission structures and platform usage. These terms will be made available to Agents during the registration process. 

 

  1. Agents listing properties on MetaHomes must possess the legal authority to market those properties, including any required licenses, permits, and the necessary consent from property owners to enter into binding agreements on their behalf. Agents are responsible for ensuring the accuracy of all property listings and must update listings promptly to correct any inaccuracies. 

 

  1. Agents agree to: 

 

  1. Hold all necessary licenses, permits, and legal authorizations required by local jurisdictions (e.g., the Dubai Real Estate Regulatory Authority [RERA]) to engage in property transactions. 

 

  1. Ensure that all activities are conducted in compliance with applicable laws, regulations, and industry standards. 

 

  1. Provide truthful, complete, and accurate information in property listings, including details on property size, condition, location, pricing, defects, encumbrances, and any other material facts. 

 

  1. Update listings promptly when properties are sold, leased, or otherwise become unavailable. 

 

  1. Provide potential buyers or renters with all legally required documents, including title deeds, ownership certificates, permits, and any legal encumbrances on the property. Delays or failure to provide such documents may result in penalties, including suspension or removal from MetaHomes. 

 

  1. Conduct all interactions professionally and in accordance with ethical standards. Misrepresentation, omission of critical property details, or unprofessional conduct may result in suspension or removal from MetaHomes. 

 

  1. Submit photographs of the property which accurately represents the actual property and must comply with applicable intellectual property laws. And Agents further agree that the photographs shall not include individuals unless their express legal consent has been obtained. MetaHomes reserves the right to remove any photographs that do not meet these standards or that violate intellectual property rights. 

 

  1. Use MetaHomes’ trademarks or logos only in accordance with MetaHomes’ guidelines. Unauthorized use of MetaHomes’ name, logo, or any related trademarks in a manner that suggests sponsorship, endorsement, or affiliation with MetaHomes, or that is otherwise misleading, is strictly prohibited. 

 

  1. Comply with MetaHomes' right to refuse any hypertext links to or addresses of third-party websites from Agents' property pages. Agents further agree that MetaHomes reserves the right to remove any such links or web addresses at its sole discretion, without notice, and may charge for hypertext links at any time. 

 

  1. Ensure that each property listing corresponds to a specific, uniquely identified property. If the Agent has purchased a listing package that permits the substitution of properties, the Agent agrees that this must be explicitly stated in the package terms and conditions. 

 

  1. Further, the Agents listing properties for sale agree to: 

 

  1. Represent and warrant that the property owner holds clear and undisputed legal title to the property or, in the case of rental listings, that the owner has the legal authority to lease the property. 

 

  1. Disclose all known material defects and legal encumbrances affecting the property, such as zoning violations, pending lawsuits, or liens, to potential buyers or renters. Failure to disclose such information may result in legal consequences and removal from MetaHomes. 

 

  1. Ensure that all property details in the listing, including size, condition, sale/lease price, and terms, are accurate and up-to-date. Providing false or misleading information may result in penalties, including suspension or removal from the platform. 

 

  1. Ensure that property owners will honor all commitments made in purchase or lease agreements, including delivery of legal documents, access to the property, and other agreed-upon terms. 

 

  1. that each listing must pertain to a specific, uniquely identified property, unless the agent has purchased a listing package that expressly allows for the substitution of properties. 

 

  1. that properties listed on MetaHomes must not be substituted without MetaHomes’ prior written consent. If the property manager’s contract for the original property is terminated, the Agent must provide sufficient proof, and the listing term shall remain the same as the original listing. 

 

  1. The Agent agrees that if they submit changes to an existing listing that would, if approved, substantially alter the listing to represent a different property, MetaHomes reserves the right to terminate the listing and retain any fees associated with the non-compliant listing as compensation for the violation. 

 

  1. Furthermore, the Agent agrees that a single listing may not represent multiple properties unless the property consists of multiple rental units, and the Agent has purchased additional listings for each individual unit. 

 

  1. End Users, who are buyers using MetaHomes for property transactions, must adhere to the following: 

 

  1. Conduct their own due diligence before entering into any transaction. MetaHomes is a platform that facilitates information exchange but does not guarantee the accuracy, completeness, or reliability of property listings. MetaHomes is not a party to any transaction and is not responsible for any agreements entered into between Agents and the End Users. 

 

  1. Seek independent legal, financial, and property advice as needed. MetaHomes does not provide legal, financial, or property advice and strongly recommends that End Users seek professional guidance before entering into any agreements with Agents. 

 

  1. Ensure that they possess the necessary financial resources and capacity to enter into a purchase or lease agreement. MetaHomes is not responsible for assessing the financial suitability or capacity of any User or End User. 

 

  1. Honor any financial obligations entered into, such as mortgage commitments, rental deposits, or other contractual obligations. Failure to comply with these obligations may result in legal action, and MetaHomes is not responsible for any legal disputes or liabilities arising from the transaction. 

 

  1. Once an End User who is a buyer or renter enters into a formal agreement with the Agent, they are bound by the terms of that agreement, including payment schedules, obligations, and penalties for breach of contract. MetaHomes is not a party to the agreement and does not bear responsibility for its enforcement. 

 

  1. All parties engaging in real estate transactions on MetaHomes shall comply with the applicable Real Estate laws as follows; 

 

  1. All Users and End Users engaged in real estate transactions on MetaHomes must comply with all applicable anti-money laundering (AML) laws and regulations. In exceptional circumstances, MetaHomes reserves the right to request additional documentation or proof of identity from any party involved in high-value transactions to ensure compliance with AML requirements. 

 

  1. Agents are solely responsible for fulfilling their tax obligations related to the sale or lease of a property, including but not limited to any VAT, property transfer fees, or other government-imposed charges. MetaHomes shall not be liable for ensuring or verifying compliance with tax obligations. 

 

  1. Agents must comply with local laws regarding property disclosures. This includes, but is not limited to, providing End Users with accurate details about the property’s condition, any environmental concerns, legal disputes, or other material facts. Failure to comply with these disclosure requirements may result in legal consequences. 

 

  1. Customer Handling Process:  

 

  1. MetaHomes Facilitates seamless interaction through various communication channels, offering a user-friendly experience for all parties involved. End users can contact MetaHomes via: 
  1. Tour Requests 
  1. Phone Calls 
  1. WhatsApp 
  1. Social Media Platforms 
  1. Online Calls 
  1. User-Submitted Requests 
  1. Booking Requests 
  1. Chats 

 

  1. When an end user expresses interest in a property listed on the MetaHomes platform, they will initiate contact with our Customer Support team through one of the communication mediums mentioned above. The Customer Support team will then direct the interested client to our MetaHomes Brokerage team to close the transaction with the registered agent representing the listed property. 

 

  1. Benefits for MetaHomes Brokerage Agents: 

 

As part of our unique offerings, MetaHomes provides Agents with a wide range of benefits, ensuring an enhanced experience when dealing with property transactions: 

 

  1. Free Listings - MetaHomes offers real estate companies the opportunity to list their properties on our platform at no cost. This allows you to advertise and gain visibility without any upfront charges, providing an effective and budget-friendly marketing solution. 

 

  1. International Exposure - As a web and app-based platform accessible worldwide, MetaHomes provides real estate companies with broader reach, connecting them to a global audience. In addition, MetaHomes invest in targeted international marketing strategies, further enhancing their global exposure and generating more leads from across the world. 

 

  1. Pre-Qualified Leads – MetaHomes customer care team ensures that all leads are thoroughly qualified before being passed on to Users. This process guarantees that the leads provided are of higher quality, with greater potential for conversion, ultimately increasing the likelihood of successful outcomes. 

 

  1. Nurtured Leads- MetaHomes employs a comprehensive lead nurturing strategy designed to engage leads that are not yet ready to make a purchase or rental decision. Through multiple stages of the sales funnel, MetaHomes carefully cultivate these leads and deliver them to Users only when Users are primed and ready to act. 

 

  1. Advertisement Discounts - are for Agents who enter into agreements with us and will be eligible for exclusive discounts on additional marketing campaigns run through our platform. This allows for enhanced visibility and further promotional opportunities.  

 

  1. Listing Priority (based on listing scores) - MetaHomes prioritize User listings based on the listing scores, ensuring that the properties are featured more prominently and receive higher visibility compared to other listings. This results in improved exposure and greater chances of attracting prospective buyers or renters. 

 

  1. AI-Based Technology & Recommendations - MetaHomes is powered by advanced AI technology, providing Users and End-Users with data-driven insights, location targeting, and behavior-based recommendations. These capabilities help Users and End-Users refine their marketing efforts and reach the most relevant audience with precision. 

 

  1. VR Shoots -MetaHomes offers complimentary VR video shoots for our Users and End Users, including the production, editing, and publication of high-quality virtual tours. This service enables property listings to stand out by showcasing properties in a more immersive and engaging way. 

  

  1. Agent Registration and Requirements 

 

  1. Agents must provide accurate and current information during registration and maintain it throughout their partnership with MetaHomes. 
  1. All agents must enter into a Referral and Non-Disclosure Agreement and a Commission Sharing Agreement with MetaHomes Brokerage to facilitate a smooth referral process and ensure the protection of client data. These agreements will be signed separately. 
  1. By signing these agreements, agents acknowledge that MetaHomes retains sole ownership of any End User referral and that any successful property purchase by an End User referred by MetaHomes will result in a 5% commission sharing obligation. 
  1. Upon successful completion of a transaction, Form I will be signed by both parties as mandated by RERA and in accordance with the applicable real estate laws of the Emirate of Dubai or other Emirates as applicable. 

 

  1. Communication and Referral Process 

 

  1.  Once a potential client [End User] expresses interest in a listed property, they will be directed to MetaHomes Brokerage, which will work directly with the listed Agent to close the deal. 
  1. The referral is conditional upon agents entering into the required agreements, including the Referral and Non-Disclosure Agreement and the Commission Sharing Agreement. 
  1. MetaHomes Brokerage reserves the right to manage the entire referral process and ensure compliance with all legal frameworks for property transactions, including but not limited to RERA’s Form I. 

 

  1. Agent Confidentiality and Data Protection 

 

  1. Agents are required to maintain the confidentiality of all End User data obtained via the MetaHomes platform, as outlined in the Referral and Non-Disclosure Agreement. The confidentiality of End User data is paramount to maintaining the integrity of MetaHomes' services. Sharing End User data with third parties without the explicit consent of the End User and MetaHomes is strictly prohibited. MetaHomes will provide End User data to the Agent solely for the purpose of facilitating the real estate transaction as outlined in these terms. 

 

  1. Property Change and Commission Waiver 

 

  1. During the process of investigating or visiting a listed property, if the End User decides to drop their interest in the original property and expresses a preference for another property listed on the MetaHomes platform, MetaHomes Brokerage will have no authority or responsibility over the change of property choice. In such cases, MetaHomes will not be held liable or responsible for any impact on the commission arrangement. 

 

  1. The commission sharing agreement, as outlined in the Commission Sharing Agreement, will only take effect upon the successful completion of a property transaction involving the End User and the original property referred through the MetaHomes platform. If the End User’s preference shifts to a different property, the commission sharing agreement for the original property will be waived, and MetaHomes will have no obligation to facilitate or be entitled to any commission for the new property. 

 

  1. In the event that the End User changes their preferred property, and the transaction is finalized on the new property, MetaHomes reserves the right to waive any claims for commission related to the original property. MetaHomes will only be entitled to the commission on the transaction of the original referred property if the deal is closed successfully as initially agreed. 

 

  1. Any new transactions related to a change in property preference will require a separate commission agreement, signed by the relevant parties involved. The original Commission Sharing Agreement will not apply to the new property transaction unless mutually agreed upon by MetaHomes and the agents involved. 

 

  1. Solicitation 

 

  1. Agents agree not to directly or indirectly solicit, contact, or attempt to engage in any real estate transactions with an End User referred through the MetaHomes platform, outside of the official MetaHomes platform and process. This includes, but is not limited to, bypassing MetaHomes' customer support team or the brokerage process to close a purchase or transaction. 

 

  1. For the purpose of this clause, "soliciting" refers to any attempt to initiate, facilitate, or close a real estate transaction, directly or indirectly, with an End User outside the referral and engagement process through MetaHomes. This includes initiating contact, offering services, or entering into agreements with the End User without MetaHomes’ prior knowledge or approval. 

 

  1. Any Agent found to be in violation of this Solicitation Clause, by attempting to independently close a transaction or circumvent the established referral process, will be considered in breach of these terms. Such actions will result in immediate suspension or termination of the Agent's access to the MetaHomes platform and may lead to legal action for breach of contract. 

 

  1. MetaHomes reserves the right to take all necessary legal actions to enforce these terms, including seeking financial compensation for damages caused by the breach. This may include pursuing legal remedies, such as claims for lost commissions or any other damages resulting from the violation. 

 

  1. Conflict of Interest 

 

  1. MetaHomes operates both as a real estate platform that lists properties for agents and brokers and as an independent brokerage facilitating its own property transactions. As an Agent using the MetaHomes platform, you acknowledge that MetaHomes' dual role may lead to situations where MetaHomes may directly facilitate property transactions through its own brokerage, which may involve properties listed on the platform. This could potentially result in MetaHomes competing with your listings or transactions. 

 

  1. Please note that MetaHomes Brokerage will only facilitate transactions for properties listed by agents if MetaHomes Brokerage is a registered agent for that property. In such cases, MetaHomes Brokerage will take the lead in facilitating the transaction, and Agents will not be involved in those specific transactions unless otherwise agreed upon. 

 

  1. MetaHomes is committed to ensuring transparency in all transactions, and any conflict of interest will be disclosed and managed in a fair and ethical manner. If you have any concerns regarding potential conflicts, you agree to notify MetaHomes immediately. 

 

  1. By partnering with MetaHomes, agents gain exclusive access to a dynamic and expansive brokerage network with extensive support, helping to enhance their transaction capabilities while ensuring that all activities comply with local and national real estate regulations. 

 

  1. ADDITIONAL TERMS FOR MERCHANTS OF METAHOMES LIFE  SERVICES 

 

  1. By using MetaHomes Life, Merchants agree to offer their services in compliance with the applicable laws, regulations, and industry standards. Merchants must maintain the necessary qualifications, licenses, and insurance to offer their services.   

 

  1. Merchants are responsible for ensuring that their service offerings are accurately represented on the MetaHomes Life platform. This includes providing detailed descriptions, availability, pricing, and any other relevant information necessary for End Users to make informed decisions. 

 

  1. MetaHomes reserves the right to review and approve the content of Merchants of MetaHomes Life’s service listings and to remove or amend any MetaHomes Life’s service listing that does not comply with MetaHomes' standards or violates any applicable laws. 

 

  1. Merchants offering their services through the MetaHomes Life platform are subject to the payment processing terms outlined in Clause 9.1.2 of these Terms, which specify the payment methods and service fees applicable to transactions made through the MetaHomes platform. 

 

  1. Service fees for MetaHomes Life services will be deducted from payments made by End Users who book services via the MetaHomes platform. The service fee will cover the provision of platform services such as customer support, platform maintenance, and other related services. 

 

  1. In the event of a dispute between an End User and a Service Provider, MetaHomes shall provide a platform for communication and facilitate the exchange of information between the parties. However, MetaHomes shall not be responsible for resolving the dispute unless the issue directly relates to the functionality, performance, or operation of the MetaHomes platform. MetaHomes does not assume any liability or obligation to mediate or settle disputes arising between End Users and Merchants. The parties involved are solely responsible for resolving any disputes, and MetaHomes disclaims any responsibility for such matters, except as specified above. 

 

  1. Merchants must handle disputes with End Users in accordance with the applicable laws, regulations, and MetaHomes’ dispute resolution guidelines. 

 

  1. MetaHomes Life through MetaHomes reserve the right to suspend or terminate a Service Provider's access to the MetaHomes platform if the Service Provider is found to be in violation of any of the terms and conditions outlined in this agreement or any applicable laws. 

 

  1. MetaHomes Life through MetaHomes makes no warranties regarding the suitability or quality of the services provided by Merchants. MetaHomes Life through MetaHomes shall not be held liable for any damages, losses, or dissatisfaction arising from the services provided by Merchants.  

 

  1. MetaHomes Life connects End Users with Merchants for the provision of life services. While MetaHomes Life reviews Merchant qualifications, it does not guarantee or warrant the reliability, accuracy, or quality of services provided by Merchants. MetaHomes only facilitates transactions and provides a platform for service provision but is not responsible for the fulfilment of the services by the Merchants. 

 

  1. By using MetaHomes Life, Merchant agrees that MetaHomes does not independently verify the authenticity or claims of each service and encourages End Users to verify service details directly with Merchants. 

 

  1. Merchants and End Users agree to comply fully with all applicable laws and regulations, including but not limited to UAE Federal Law No. 15 of 2020 on Consumer Protection and UAE Federal Law No. 45 of 2021 on Personal Data Protection, as well as any other relevant laws related to the services they provide or use. 

 

  1. End Users shall perform all necessary due diligence in assessing the quality and suitability of services offered by Merchants, including confirming service details, costs, and the Merchant's compliance with applicable laws and regulations. 

 

  1. End Users further accept that they engage with Merchants and avail services at their own risk. MetaHomes is not responsible for any direct or indirect consequences arising from the services rendered by Merchants. 

 

  1. Merchants are solely responsible for ensuring that the services they provide meet the advertised standards, comply with all relevant legal requirements, and are delivered to the satisfaction of the End User. 

 

  1. Merchants agree to indemnify and hold MetaHomes harmless from any claims, damages, or liabilities arising from their provision of services or any failure to meet their obligations under applicable laws or these Terms. 

 

  1. Payments, Refunds, and Payouts for Merchants under MetaHomes Life services 

 

  1. MetaHomes Life charges a service fee on each transaction facilitated between End Users and Merchants for services provided through the platform. This service fee is deducted from the total payment processed for the service and is non-refundable under any circumstances. The specific terms and amount of the service fee will be outlined in a separate Merchant Agreement, which will be executed between Merchant and MetaHomes. 

 

  1. End Users may be eligible for a full refund if they cancel a service at least twenty-four (24) hours prior to the scheduled start time of the service, subject to verification by MetaHomes Life. If a Merchant cancels a service for any reason, End Users will be entitled to a full refund for the amount paid for that service.  

 

  1. Cancellations made by the End User within less than twenty-four (24) hours of the scheduled service may be eligible for a partial refund, the amount of which will be determined based on the service's progress, the nature of the cancellation, and other relevant factors as determined at MetaHomes Life's sole discretion. 

 

  1. End Users are not eligible for refunds if the service has been completed, except where a valid service quality complaint is substantiated. Complaints will be handled on a case-by-case basis and subject to MetaHomes Life's review and determination. 

 

  1. MetaHomes Life reserves the exclusive right to approve or deny all refund requests. Refunds will only be processed in strict accordance with the terms set forth in these Terms. MetaHomes Life is under no obligation to issue refunds unless the refund request meets the established criteria and conditions. 

 

  1. Merchant payouts will be subject to fourteen (14) days holding period from the date of service completion to allow for dispute resolution. Merchants are required to submit a completed service invoice for each payout request. MetaHomes reserves the right to delay or deny payouts if the Merchant fails to comply with invoicing requirements or if there are outstanding disputes regarding the service provided. The payout period will commence once the service is marked as complete by both the End User and the Merchant. Delays or failures to submit required documentation may extend this payout period. 

 

  1. End Users and Merchants are prohibited from engaging in any defamatory, malicious, or illegal activities that could harm MetaHomes, its affiliates, or other users of the platform. End Users and Merchants shall not post unsubstantiated reviews or false information, nor take any actions that would undermine the integrity of the platform. Violators may face suspension or termination of their accounts, and any such actions may result in legal action if deemed necessary. 

 

  1. End Users and Merchants are strictly prohibited from making false or defamatory statements about MetaHomes, its affiliates, or any of its partners, including Merchants or other End Users. Violations of this clause may result in immediate suspension or termination of accounts, as well as legal action if appropriate. 

 

  1. MetaHomes Life through MetaHomes and its affiliates retain full ownership of all intellectual property related to the platform, including software, content, trademarks, and designs. Merchants and End Users are granted a limited, non-exclusive, non-transferable license to use the platform solely for the purpose of listing and offering their services in accordance with these Terms.  

 

  1. MetaHomes Life is a marketplace platform that facilitates the connection between End Users and Merchants but does not take responsibility for the delivery or quality of services provided by Merchants. MetaHomes Life disclaims all liability for the services provided by Merchants, including any inaccuracies, deficiencies, or failure to deliver services as promised, except in cases of gross negligence or fraud directly attributable to MetaHomes. 

 

  1. DEFEMATION CLAUSE 
     
  1. All Users/End Users of the MetaHomes platform agree not to post or transmit any content that is defamatory. This includes, but is not limited to, any content that could be deemed legally libelous or slanderous or that falsely degrades, intimidates, or harms the reputation of another person or entity. This specifically encompasses all forms of written, spoken, or visual statements that might unjustly damage the reputation of real estate professionals or properties listed on the platform. 

 

  1. Users are solely responsible for all the content they upload, post, email, transmit, or otherwise make available via MetaHomes. MetaHomes assumes no responsibility for the content posted by users and does not pre-screen posted content. However, MetaHomes reserves the right to review and, if necessary, remove any content that violates this clause without prior notice. 

 

  1. MetaHomes encourages Users to report any content they believe to be defamatory or in violation of these terms. MetaHomes will review such reports promptly and act in accordance with the platform’s policies and applicable law. 

 

  1. The failure of MetaHomes to enforce any right or provision of these terms shall not be deemed a waiver of such right or provision. If any provision of this clause is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the terms remain in full force and effect. 

 

  1. The User guarantees that the services provided through the MetaHomes platform will be of professional quality and consistent with the descriptions provided on the platform. The User further guarantees that it will comply with all applicable laws and regulations governing the provision of its services. 

 

  1. DISCLAIMERS  

 

  1. MetaHomes, including all content, software, functions, materials, and information available on or accessed through the platform, is provided on an “as-is” basis. To the fullest extent permitted by law, MetaHomes makes no representations or warranties of any kind, express or implied, with respect to the accuracy, completeness, reliability, or availability of the content, services, software, or any third-party links provided through MetaHomes. This includes, but is not limited to, any warranties related to merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. 

 

  1. You acknowledge that MetaHomes is a platform for listing and advertising properties, holiday homes, and other services. We do not guarantee, nor are we responsible for, the accuracy, quality, or safety of any property or service listed by Users. We are not a party to of our Users and End Users. MetaHomes does not review, verify, or endorse any property listings or services provided by Users.  

 

  1. For any transaction related to property purchase is strictly between the User and the End User, and the User and End User agree not to hold MetaHomes responsible for any disputes, losses, or damages arising from these transactions.  As stipulated in this Terms the User shall be subject to a service charge as per the applicable agreement signed between Metahomes. 

 

  1. For MetaHomes provides a payment gateway to facilitate the processing of payments for vacation or holiday home rental services, including bookings and related services via the MetaHomes platform. Upon successful payment, MetaHomes will hold the transaction and deduct a service fee as agreed by the User and MetaHomes from the total booking amount. This service fee will be deducted at the time of payment acceptance made by the Host. 

 

  1. While we strive to ensure the payment process is secure, efficient, and transparent, MetaHomes is not liable for any issues related to the payment process, including but not limited to payment failures, delays, fraudulent transactions, or payment disputes. You acknowledge that any issues related to payment, including disputes over charges, fraud, or other payment-related concerns, should be resolved directly with the payment provider, financial institution, or third-party payment processor. 

 

  1. MetaHomes is responsible for processing the transaction and deducting the applicable service fee at the time of payment acceptance. However, we do not assume liability for any issues that may arise beyond this process, such as errors in the payment system, delays in transaction processing, or any discrepancies in the amount charged. By using the MetaHomes payment gateway, you agree that MetaHomes will not be held responsible for any losses, damages, or inconvenience incurred during the payment process. You agree to address any payment-related disputes directly with the relevant payment provider or financial institution. 

 

  1. While MetaHomes provides a payment gateway and facilitates financial transactions on the platform, we do not guarantee the security of financial transactions. MetaHomes is not responsible for any failures, errors, fraud, chargebacks, or security breaches that may occur during the transaction process. Users and End Users are advised to ensure that their payment information is securely handled through the platform’s gateway, and any disputes related to payments should be resolved directly with the payment provider or financial institution. 

 

  1. MetaHomes does not guarantee the safety, quality, or accuracy of any property listed on the platform. All listings, including vacation homes, rental properties, and other services, are the sole responsibility of the property owner or service provider. MetaHomes is not liable for any damages, accidents, injuries, or other issues that may arise from a property or service listed on the platform. Users are advised to exercise caution and conduct their own due diligence before engaging in any transactions. 

 

  1. MetaHomes uses AI-driven search algorithms to display and recommend properties and services listed by Users. While we strive to offer relevant search results and recommendations, we do not guarantee that the AI-driven search engine will always display the most suitable or accurate properties or services. Users should independently verify the details of any listing before making any purchase or rental decision. 

 

  1. MetaHomes may contain links to third-party websites or services, including Social Media Sites, external payment gateways, or third-party booking platforms. These links are provided for convenience only and do not constitute an endorsement or approval of the content or services provided on those websites. MetaHomes is not responsible for any third-party websites or services, and you access them at your own risk. We encourage Users to review the terms, conditions, and privacy policies of any third-party websites you visit. 

 

  1. MetaHomes does not warrant or guarantee the safety, accessibility, or quality of any destination, property, or service listed on the platform. You acknowledge that by using the platform to book or rent properties or services, you do so at your own risk. MetaHomes is not liable for any injuries, damages, losses, or inconveniences resulting from your travel to a destination or use of any property or service listed on the platform. 

 

  1. You acknowledge and agree that communications, including User-Generated Content and other information submitted to MetaHomes, are not confidential. Any information or content submitted through the platform may be intercepted or read by third parties. MetaHomes is not responsible for the security or privacy of any communications sent to or from the platform. 

 

  1. By posting content on MetaHomes, such as property listings or service offerings, no fiduciary, contractual, or other implied relationship is created between you and MetaHomes, except as expressly outlined in these Terms and Conditions. MetaHomes does not assume any responsibility for overseeing or facilitating any rental, sale, or service agreement made between Users or between Users and End Users. 

 

  1. To the fullest extent permitted by law, MetaHomes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data arising out of or related to your use of the platform, even if MetaHomes has been made you aware of the possibility of such damages. In no event shall MetaHomes’ total liability exceeds the amount you have paid to MetaHomes for the use of the platform during the twelve (12) months preceding the event giving rise to the claim. 

 

  1. LIMITATIONS OF LIABILITY 

 

  1. In no event will MetaHomes Real Estate and Brokerage FZ LLC, or its parent company, subsidiaries, affiliates, officers, directors, consultants, agents, and/or employees (collectively, the “MetaHomes”), or any third-party provider of a service or tool offered on any site of a member of MetaHomes (each a “Third-Party Provider”), be liable for any lost profits or any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from (A) MetaHomes, (B) these Terms, (C) any breach of these Terms by you or a third party, (D) use of the site, tools, or services we provide, or any third-party provider provides, related to the business we operate on MetaHomes, by you or any third party, (E) any User-Contributed Content, (F) interaction between MetaHomes and any third-party site, including without limitation a Social Media Site, facilitated by a tool or service on MetaHomes, and/or (G) any actual or attempted communication or transaction, including without limitation, any payment transaction (even if we or any third-party provider receives a fee in connection therewith) between users, in each case, even if we have been advised of the possibility of such damages. 

 

  1. These limitations and exclusions apply without regard to whether the damages arise from (A) breach of contract, (B) breach of warranty, (C) strict liability, (D) tort, (E) negligence, or (F) any other cause of action, to the maximum extent such exclusion and limitations are not prohibited by applicable law. 

 

  1. If you are dissatisfied with MetaHomes, you do not agree with any part of these Terms, or have any other dispute or claim with or against us, any third-party provider, or any user of MetaHomes with respect to these Terms or MetaHomes, then your sole and exclusive remedy against us is to discontinue using MetaHomes. 
     
  1. JURISDICTION AND LAW 

 

  1. These Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), United Arab Emirates. The DIFC courts shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.  

 

  1. NOTICES TO USERS 

 

  1. When MetaHomes needs to send any types of notices or newsletters to Users and End Users, it will be sent to the email address you provided during registration or booking, or any updated email address in your account (as applicable). Notices shall be deemed given upon receipt or 24 hours after the email is sent, unless the sending party is notified that the email address is invalid. 

 

  1. Alternatively, if any notice may be sent by certified mail, postage prepaid, and return receipt requested, to any physical address you have provided. Such notice shall be deemed given three (3) days after mailing to a physical address and one day after mailing to an electronic address 

 

  1. PLATFORM CHANGES, SPECIAL PROGRAMS, AND TERM UPDATES 

 

  1. MetaHomes reserves the right, at its sole discretion, to change, suspend, or discontinue any aspect of the platform at any time, including its features, database, or content, without prior notice or liability. We may impose limits on certain features or restrict your access to parts of the platform, including suspension or termination of your account, as necessary. 

 

  1. In addition, MetaHomes may offer special programs, products, or services that have their own separate terms and conditions, which will apply in place of or in addition to these general Terms. These separate terms may supersede or supplement the general Terms, depending on the nature of the program, product, or service. By participating in such programs or using such products or services, you agree to abide by both the general Terms and any specific terms that apply to the particular program, product, or service. 

 

  1. MetaHomes may also amend these Terms at any time, and such amendments will be posted on the platform with an updated "Last Updated" date. The revised Terms will become effective immediately upon posting. It is the responsibility of Users and End Users to regularly review the Terms to ensure they are aware of any updates. By continuing to use the MetaHomes platform, you agree to be bound by the updated Terms. 

 

  1. Additionally, MetaHomes reserves the right, but assumes no obligation, to agree to different or conflicting terms with any User. Any conflicting terms shall only be enforceable if specifically agreed to by MetaHomes. 

 

  1. RETENTION OF TERMS AND AGREEMENT STRUCTURE 

 

  1. MetaHomes does not separately file the Terms entered into by each User. It is your responsibility to retain a copy of these Terms for your records. By using the MetaHomes platform, you agree to comply with these Terms, which govern your use of the platform. In addition to these Terms, MetaHomes may enter into separate agreements for specific terms subject to the services offered on the platform. In the event of any conflict between the separate agreements and these Terms, the specific agreements will govern for those services, but these Terms shall remain the primary terms applicable to the general use of the platform. 

 

  1.   DISTRIBUTION OF LISTINGS TO THIRD-PARTY WEBSITES 

 

  1. MetaHomes may, at its discretion, distribute listings and content provided by Users to third-party websites. This distribution is intended to help the Users gain broader exposure for their properties or services. 

 

  1. Any distribution of User content to third-party platforms will be subject to additional terms and conditions. MetaHomes will notify Users of these terms through their MetaHomes account or via email when applicable. By listing on MetaHomes, Users agree to these terms. 

 

  1.   TERMINATION OF LISTINGS AND OTHER REMEDIES 

 

  1. MetaHomes reserves the right to limit or terminate a User’s use of the platform, restrict the visibility of their listings, or remove their listings entirely under the following circumstances: 

 

  1. If a User submits inappropriate, illegal, or misleading material to the platform. 

 

  1. If a User violates local rental, sale, or other relevant regulations. 

 

  1. If a User’s actions negatively impact the MetaHomes platform or its community. 

 

  1. If a User misuses the MetaHomes platform or system, including engaging in fraudulent activity. 

 

  1. MetaHomes may remove a User’s listing(s) if it receives a complaint or identifies conduct that violates the platform's standards. Such actions may result in the immediate removal of the listing or termination of a booking, without prior notice to the User and without refund of any fees paid by the Host or Agent. Examples include, but are not limited to: 

 

  1. Double-booking a property or engaging in unfair or deceptive practices. 

 

  1. Suspecting that the User’s payment-related practices are not secure, legal, or compliant. 

 

  1. Receiving complaints that the User’s content infringes on the rights of a third party (e.g., intellectual property infringement). 

 

  1. If a User engages in abusive, offensive, or inappropriate behavior towards any MetaHomes employee or representative, MetaHomes reserves the right to immediately remove the User’s listing or booking, without refund. 

 

  1. In addition to terminating or removing listings, MetaHomes reserves the right to take other actions in response to any violation of these Terms, including but not limited to: 

 

  1. Removing a listing from search results. 

 

  1. Marking the User as a “Non-authenticated User.” 

 

  1. Removing or modifying information that may be misleading or false. 

 

  1.  INDEMNITY FOR VIOLATION OF TERMS 

 

  1. By using the MetaHomes platform, Users (including Hosts, Agents, and Service Providers) agree to indemnify, defend, and hold harmless MetaHomes, its affiliated companies, officers, directors, employees, and agents from any third-party claims, damages, losses, fines, penalties, or expenses (including reasonable legal and accounting fees) arising out of or resulting from: 

 

  1. The User’s breach of these Terms and Conditions or any other agreements referenced herein. 
  1. Any violation by the User of applicable laws or third-party rights. 

 

  1. The User’s misuse of the MetaHomes platform, including any activities that are deemed outside the normal or acceptable use of the platform. 

 

  1. This indemnification applies to any legal action brought by third parties as a result of the User’s actions, whether those actions occur within or outside of the scope of their use of MetaHomes services. Users are responsible for all costs, including legal fees, incurred by MetaHomes in defending such claims. 

 

  1. MISCELLANEOUS PROVISIONS 

 

  1. Metahomes will not trade with or provide any services to OFAC and sanctioned countries by UAE. 

 

  1. MetaHomes reserves the right to amend, modify, or update these Terms at any time. Any changes will be communicated to Users and Merchants via platform updates, and the "Last Updated" date at the top of these Terms will reflect the most recent changes. It is the responsibility of Users and End Users to regularly review these Terms to stay informed of any updates. Continued use of MetaHomes after any changes constitutes acceptance of the revised Term. 

 

  1. If any provision of these Terms is found to be invalid, unenforceable, or contrary to applicable law, the remaining provisions shall continue in full force and effect.  

 

  1. These Terms, along with any supplemental terms disclosed at the time of service, represent the entire agreement between MetaHomes and Users and End Users accessing or using the platform. This includes, but is not limited to, any separate agreements that may be executed with Users, (Agents, Hosts, or Merchants) which form an integral part of these Terms. By using the platform, Users acknowledge that these Terms, together with any applicable supplemental agreements, constitute the complete and exclusive understanding between the parties and supersede any prior agreements or understandings, whether written or oral, relating to the use of the platform.
